Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Meadow mobile application and website at https://meadow.ostrahealth.com (the “Services”) operated by Ostra Health, Inc. (“we,” “us,” or “our”). By using the Services, you agree to these Terms.

1. The Services

Meadow is a wellness-oriented migraine and headache journal. Features may include attack logging, medication tracking, barometric/weather-related risk context, insights, and doctor report PDFs. Features may change over time.

Not medical advice. Meadow does not provide medical advice, diagnosis, or treatment. It is not a medical device. Always seek the advice of a qualified clinician with questions about a medical condition.

2. Eligibility and accounts

You must be able to form a binding contract to use the Services. You are responsible for your account credentials and for activity under your account. Provide accurate information and notify us of unauthorized use at meadowsupport@ostrahealth.com.

3. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use Meadow for your own personal, non-commercial purposes. You may not copy, reverse engineer, or misuse the Services, interfere with their operation, or use them unlawfully.

4. Your content

You retain ownership of the journal content you submit. You grant us a limited license to host, process, and display that content as needed to operate the Services (for example syncing your journal and generating reports you request). You are responsible for the accuracy of information you enter.

5. Subscriptions and payments

Some features require Meadow Pro, an auto-renewable subscription offered through the Apple App Store (and Google Play if available). Current plans include weekly and seasonal (approximately three months) options; prices are shown in the store at purchase and may vary by territory.

• Payment is charged to your store account at confirmation of purchase.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period in your store account settings.
• Manage or cancel in App Store / Google Play subscription settings. Deleting the app does not by itself cancel a subscription.

Purchases are also subject to the terms of Apple or Google, as applicable.

6. Privacy

Our Privacy Policy and Consumer Health Data Privacy Policy describe how we handle personal and health-related information.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT FORECASTS, INSIGHTS, OR REPORTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR CLINICAL DECISIONS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSTRA HEALTH, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR MEADOW PRO IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

9. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of the Services or your violation of these Terms, to the extent permitted by law.

10. Termination

You may stop using the Services at any time and may delete your account in the app. We may suspend or terminate access if you violate these Terms or if we discontinue the Services.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory local law provides otherwise.

12. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use after changes means you accept the updated Terms.
